I work for that state of Maryland as a salary employee under exempt for overtime. I'm about to lose 420 hours as a supervisor. Who can help me recover some of the time if not all as management done the same thing a couple of years prior?
I don't live in the states, but we have similar terms in high tech.
Unfortunately, if it's in the contract, judges have been ruling in favour of the employers. The approaches I've seen were either legal loopholes or proving the actual job wasn't of a managerial nature.
It's prolly best to try averting this situation in the first place.
