Skyrim- Can I kill a merchant then take the items that he sells for free?or do I have to buy them?

Sometimes can be a glitch and most of the items for sale will "disappear", otherwise whatever they have on them will be free. If you kill in front of witnesses or in a town it is really not worth doing.
