as far as i know america still has a death penalty. especially "texas" and "nevada" and i think "california" has it but i'm sure. i know there's others to like "alaska" i think. i'm not too good with politics but i know some.
It depends on which state conviction is in. So far no fed rule,only states rights on the issue.
