While I was at work one night, I get a notification that my alarm has been activated. I checked on my security footage and did not see anything. I disarmed the alarm (smartphone based) and just dismissed it as a false alarm. I arrive in the morning to find my neighbours dog had pried open a window, ripped through my screen and broke into my house to get at my dog which was in heat. I contacted the bylaw officer and filed a complaint via e-mail (I have these records). Nothing came of it but I only saw the dog a couple times after that and shooed him away. I have security footage of this dog on my property and in my house.
A month and a half later, I find out my dog has been impregnated by this dog. I am not forced to decide between ovariohysterectomy abortion or having a litter of mutt puppies. I likely will choose the abortion as I cannot guarantee my dogs safety and health if she has complications during birth and I am not around or can not get her to the vet in time.
I would like to first ask my neighbours to pay for the damages to my property caused by their dog and the vet bills. If they decline, I would like to sue them for these costs as well as the emotional (trust me, this is very traumatic having my personal home violated and having to subject my dog to this, I consciously chose NOT to spay her as I always keep tabs on her and feel that subjecting her to undo risk is not appropriate) distress this has and is causing me. Is it merited? Thoughts?

I also wanted to add that this happened during the night (I work night shift), my neighbours let their apparently unneutered dog roam free in the community day and night. He has visited my property multiple times through the day and night (apparent by my time stamped video footage from my outdoor camera) and frequently set off my alarm system in the middle of the night because he would scratch at my door trying to get in. My next door neighbour has also witnessed this dog scratching at my door and at my window attempting to gain entrance into my house.

Yes. Suing is an option. I would consult a lawyer and see what you can do about the impregnation of your dog but I doubt that will have any yield; however, you definitely can sue for the damage of your property. Also, that dog is legally property of you so if you view the impregnation of this dog as a "damage" you may be able to sue for at least the payment of the abortion of it's litter. (I do strongly advise against aborting baby dogs but that can get political quickly so I won't bring that up) I would also talk to your neighbors and see if they are willing to pay before you sue. (make it known that you plan to do that if they don't pay)
