Also my son doesn't have his father's last name he took my last name. The reason I am changing his last name is because I got married and I want my son to have the same last name as me

I think he is trying to scare you which he has done then come right out and ask him doesn't sound like he wants the child I would just do it he should have no problem giving up the rights he doesn't care about anyway.

I know that when you have a child and you want to change his last name you have to legally get permission from the biological father, even for adoption as well cause that is the law. You might want to attain an attorney and find out what the legality is and the process which you have to follow. There are laws and papers that will have to be signed by all parties involved.
No he doesn't pay child support. I'm just scared to go to court because he is always telling me if we go to court he will ask for visitation right's and I don't want that. My son doesn't even know him and he lives so far away from me it would be very hard for me for my son to be away from me. He wont even let my husband adopt him. It just makes me mad that he doesn't call or ask about him or send him and gifts for his birthday but yet he has soo much control over us and wont let us carry on with our lives and let my son have an actual father figure
